By booking a tour or using our services, you agree to be bound by these Terms and Conditions.


2. Booking and Payment


2.1 Booking Process
  • All bookings must be made through our website or by contacting us directly
  • Bookings are subject to availability and confirmation
  • A booking is only confirmed once payment has been successfully processed
  • We reserve the right to decline any booking at our discretion
2.2 Payment
  • Payment must be made in full at the time of booking unless otherwise agreed
  • We accept major credit cards and other payment methods as displayed on our website
  • Prices may change without notice, but confirmed bookings will honor the original price
2.3 Group Bookings
  • Maximum capacity per tuk-tuk varies by vehicle type and will be specified at booking
  • Children under 12 must be accompanied by an adult
  • We reserve the right to refuse service to intoxicated or disruptive passengers


3. Cancellation and Refund Policy


3.1 Customer Cancellations
  • Full Refund: Cancel at least 24 hours before the scheduled start time of your tour
  • No Refund: Cancellations made less than 24 hours before the tour start time
  • Grace Period: You may receive a full refund if you cancel within 24 hours of your original purchase time, regardless of tour date


3.2 Company Cancellations
  • We may cancel tours due to weather conditions, safety concerns, or circumstances beyond our control
  • In case of company cancellation, you will receive a full refund or the option to reschedule
  • We are not liable for any additional costs incurred due to cancellations (hotels, flights, etc.)


3.3 Refund Processing
  • Refunds will be processed within 5-15 business days
  • Refunds will be issued to the original payment method
  • Bank processing fees may apply and are not covered by us


4. Rescheduling Policy


4.1 Customer Rescheduling
  • Tours may be rescheduled up to 24 hours before the original scheduled start time
  • Rescheduling is subject to availability
  • The cancellation policy applies based on the original booking date and time
  • Only one free reschedule is permitted per booking
4.2 Company Rescheduling
  • We may reschedule tours due to operational requirements, weather, or safety concerns
  • We will provide as much notice as possible
  • Alternative dates/times will be offered, or a full refund if rescheduling is not possible


5. Weather Policy


5.1 Weather Cancellations
  • Tours may be cancelled due to severe weather conditions that pose safety risks
  • Light rain does not typically result in cancellation (rain covers are provided)
  • Weather-related cancellations will result in a full refund or rescheduling option
  • Weather conditions are assessed on the day of the tour
5.2 Customer Responsibility
  • Customers should dress appropriately for weather conditions
  • Tours operate in most weather conditions with appropriate safety measures


6. Safety and Conduct


6.1 Safety Requirements
  • All passengers must follow safety instructions provided by the guide/driver
  • Seatbelts must be worn when provided
  • Passengers must remain seated while the vehicle is in motion
  • We reserve the right to refuse service to anyone who appears intoxicated or under the influence of drugs
6.2 Prohibited Items
  • Smoking is prohibited in all vehicles
  • Food and drinks may be restricted depending on the tour
  • Large bags or luggage may not be permitted due to space constraints
6.3 Behavior Standards
  • Respectful behavior toward guides, other passengers, and local communities is required
  • Disruptive, offensive, or dangerous behavior will result in immediate tour termination without refund
  • Damage to vehicles or property will result in charges for repair costs


7. Health and Age Restrictions


7.1 Health Requirements
  • Passengers with mobility issues should inform us at the time of booking
  • Pregnant women should consult with us before booking
  • Passengers with heart conditions, back problems, or other health concerns participate at their own risk
7.2 Age Restrictions
  • Children under 3 years old travel free but must sit on an adult's lap
  • Children 3-12 years old require adult supervision
  • Minors under 18 must be accompanied by an adult or have written parental consent


8. Liability and Insurance


8.1 Limitation of Liability
  • We maintain appropriate insurance coverage for our operations
  • Our liability is limited to the amount paid for the tour
  • We are not responsible for personal belongings lost or damaged during tours
  • We are not liable for indirect, consequential, or special damages
8.2 Personal Responsibility
  • Passengers participate in tours at their own risk
  • We recommend travel insurance for all participants
  • Passengers are responsible for their personal belongings
  • Any injuries or damages caused by passenger negligence are the passenger's responsibility


9. Photography and Media


9.1 Photography Policy
  • We may take photographs or videos during tours for marketing purposes
  • By participating in tours, you consent to the use of your image in our promotional materials
  • If you do not wish to be photographed, please inform your guide at the start of the tour
9.2 Social Media
  • We encourage sharing your experience on social media
  • Be respectful of other passengers' privacy when posting photos


10. Intellectual Property


10.1 Tour Content
  • Unauthorized commercial use of our tour content is prohibited
  • Our brand name, logo, and marketing materials are protected by trademark


11. Data Protection

12. Force Majeure
